TERMS & CONDITIONS

1. Acceptance
 

(a) This Agreement is between KORE Movement Pty Ltd (ABN 87 101 098 081) (we, our or us) and you, the individual who purchases or enrols in any coaching services, programs or related offerings (Services) via our website located at www.koremovement.com.au (Site) or via our coaching platform (App).


(b) By enrolling in or purchasing the Services, you agree:


(1) That you have reviewed and accept these Terms and Conditions (Terms); and
(2) That you have the legal capacity to enter into a legally binding agreement with us.


(c) You must not purchase or enrol in the Services unless you are at least 18 years of age.

2. Accounts
 

(a) You may be required to create an account via our coaching platform (Account) to access the Services.


(b) When creating an Account, you must provide accurate personal information including your full name, contact details, health history and payment details.


(c) You are responsible for ensuring that all information provided is accurate and up-to-date.


(d) You are liable for all activity conducted under your Account.


(e) You may be required to complete a health assessment questionnaire prior to commencement.

3. Enrolment
 

(a) By enrolling in a coaching program, you make an offer to purchase the Services at the price notified at the time of enrolment.


(b) We may accept or reject your enrolment at our discretion.


(c) Once accepted, a binding agreement is formed between you and us for the provision of the Services in accordance with these Terms.


(d) It is your responsibility to review all program details, pricing and inclusions before enrolling.

4. Price and Payment
 

(a) All prices are stated in Australian Dollars and include GST where applicable.


(b) Payment options include:


(1) Weekly direct debit payments; or
(2) Full upfront payment for the initial 12-week term.


(c) If you select weekly payments, you authorise us to debit your nominated credit card or bank account each week.


(d) If a payment fails or is declined:


(1) We may suspend access to the Services;
(2) Outstanding balances must be paid before Services resume.


(e) All payments are final and must not be made via fraudulent or unlawful means.

5. Minimum Commitment
 

(a) All coaching programs require a minimum 12-week commitment.


(b) You cannot cancel your membership during the initial 12-week period.


(c) The minimum commitment exists due to the personalised nature of the Services and the time required to achieve meaningful progress.

6. Refund and Cancellation Policy
 

(a) We do not offer change of mind refunds for coaching programs, service subscriptions, digital products, resources or once-off plans.


(b) Failure to complete onboarding requirements, submit check-ins, attend coaching calls or engage with the program does not entitle you to a refund.


(c) If a plan requires adjustment due to an administrative or programming error made by KORE Movement, we will rectify the issue within a reasonable timeframe. Such corrections do not entitle you to a refund.


(d) There is no cooling off period. Upon enrolment, you agree to commit to the minimum 12-week term.


(e) All coaching programs are subject to a mandatory 12-week minimum commitment and cannot be cancelled during this period.


(f) Coaching services are non-transferable. Your membership cannot be resold, assigned, gifted or transferred to another individual.


(g) Under no circumstances can the Account name of the original member be changed.

7. Suspension and Cancellation


7.1 Suspension After Minimum Term


(a) Coaching may only be suspended after completion of the initial 12-week commitment.


(b) To request a suspension, you must:


(1) Email support@koremovement.com.au with no less than 3 days’ written notice; and
(2) Submit the Suspension Request Form.


(c) Suspensions are not available during the initial 12-week term unless otherwise agreed in writing.


(d) After completion of the initial 12-week program, you may request a suspension:


(1) For a minimum of 2 weeks; and
(2) For a maximum of 6 weeks in a given calendar year.


(e) All suspension requests are subject to approval and must be confirmed in writing.


(f) During an approved suspension period:


(1) Coaching services will be paused; and
(2) Weekly payments will also be paused.

7.2 Cancellation After Minimum Term


(a) You cannot cancel your coaching during the initial 12-week commitment.


(b) To cancel after completing the 12-week commitment, you must:


(1) Email support@koremovement.com.au;
(2) Complete the Cancellation Form;

(3) Attend a scheduled Exit Interview;
(4) Provide a minimum of 2 weeks’ written notice; and
(5) Ensure all outstanding balances are paid in full.


(c) Your cancellation will not be processed until all requirements have been completed.


(d) No refunds are provided for unused coaching periods.

8. Results Guarantee
 

(a) We offer a performance-based guarantee:


Lose 8-12 kg in your first 12 weeks or we’ll coach you for free until you do.

(b) To qualify for the Results Guarantee, you must demonstrate full compliance with the program requirements, including:

(1) Completing all assigned workouts;
(2) Following your prescribed meal plan and logging all meals;
(3) Meeting the prescribed daily step targets;
(4) Attending all scheduled check-in calls;
(5) Submitting weekly check-in forms;
(6) Logging weigh-ins and all required progress data; and
(7) Demonstrating consistent adherence as reasonably determined by us.

(c) If you have not lost at least 8 kg within the initial 12-week program, and you have met all compliance requirements, we will continue coaching you at no additional cost until you have lost at least 8 kg in total.

(d) To remain eligible for the free coaching period, you must continue to meet all compliance requirements listed above.
 

(e) If at any time during the additional coaching period you fail to maintain the required compliance, the Results Guarantee will be considered void and the free coaching period will immediately cease.

(f) The guarantee does not apply where relevant information was withheld, where inaccurate information was provided, or where medical conditions arise that fall outside our professional scope.

9. Scope of Services and Medical Disclaimer
 

(a) Our Services include personalised online training and nutrition coaching.


(b) We do not provide medical advice, diagnosis or treatment.


(c) You acknowledge that exercise and dietary changes involve inherent risks.


(d) Participation is voluntary and undertaken at your own risk.


(e) You confirm you are medically fit and have disclosed all relevant health conditions.


(f) We reserve the right to decline or discontinue Services where a condition falls outside our professional scope.

10. Eligibility Restrictions
 

Our Services are not suitable for individuals who:


(a) Are currently pregnant or breastfeeding;
(b) Have had weight-loss surgery;
(c) Have an active eating disorder;
(d) Have Coeliac disease;
(e) Have diabetes;
(f) Have thyroid disease.

11. Intellectual Property
 

(a) All programs, meal plans, documents, resources and systems remain our intellectual property.


(b) You must not copy, reproduce, distribute, resell or share any part of the Services without written consent.

12. Limitation of Liability
 

(a) To the maximum extent permitted by law:


(1) Our total aggregate liability is limited to the total amount paid by you for the relevant Services; and
(2) We are not liable for loss of profit, revenue, opportunity or any indirect or consequential loss.


(b) We are not liable for outcomes not achieved due to lack of adherence.


(c) We are not liable for injury or illness arising from undisclosed medical conditions.

13. Privacy
 

(a) We collect personal information to manage your Account and provide the Services.


(b) You consent to us collecting, storing and using your information for service delivery.


(c) We may disclose information to third-party providers (including payment processors and software providers) as required.

14. General
 

(a) Entire Agreement: These Terms constitute the entire agreement between you and us.


(b) Variation: We may amend these Terms at any time by publishing updated Terms on our Site.


(c) Waiver: Failure to enforce a right does not constitute a waiver.


(d) Assignment: You may not transfer your membership or assign your rights.


(e) Governing Law: These Terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales.
